La Cour africaine va statuer sur 5 affaires

Ce vendredi 3 juin 2016, à partir de 10h (Heure d’Afrique de l’est), la Cour africaine des droits de l’homme et des peuples (Cour africaine) délivrera 4 jugements et rendra une décision dans les affaires suivantes :

  1. Affaire 002/2013 : Commission africaine des droits de l’homme et des peuples c. Libye ;
  2. Affaire 004/2013 : Lohé Issa Konaté c. République du Burkina Faso ;
  3. Affaire 007/2013 : Mohamed Abubakari c. République-unie de Tanzanie ;
  4. Affaire 003/2014 : Ingabire Victoire Umuhoza c. République du Rwanda ;
  5. Affaire 001/2012 : Frank David Omary c. République-unie de Tanzanie.

Dans l’affaire Mohamed Abubakari, l’Union panafricaine des avocats (PALU) a représenté le requérant de façon pro bono sous le régime d’aide juridique de la Cour africaine. Le requérant, un citoyen tanzanien, a été reconnu coupable de vol à main armée et condamné à 30 ans de prison.

Le requérant a fait valoir devant la Cour africaine qu’en tenant compte de la gravité de l’infraction pour laquelle il a été accusé, l’Etat défendeur, en omettant de lui fournir une assistance juridique, a violé son droit à un procès équitable, protégé par l’article 7 de la Charte africaine.

Le requérant cherche donc à obtenir une déclaration de la Cour africaine reconnaissant que l’Etat défendeur a violé son droit à un procès équitable et une ordonnance enjoignant les tribunaux de l’Etat défendeur à rouvrir son procès.

Le jugement sera rendu au siège de la Cour africaine, situé dans les bâtiments TANAPA, à Arusha, en Tanzanie.

The African Court to Adjudicate on 5 Cases
On Friday, 3 June 2016, from 10.00 a.m. (East African time) the African Court on Human and Peoples’ Rights (African Court) will deliver 4 Judgements and a Ruling in the following cases:
  1. Application 002/2013: African Commission on Human and Peoples’ Rights vs Libya;
  2. Application 004/2013: Lohé Issa Konaté vs Republic of Burkina Faso;
  3. Application 007/2013: Mohamed Abubakari vs United Republic of Tanzania;
  4. Application 003/2014: Ingabire Victoire Umuhoza vs Republic of Rwanda;
  5. Application 001/2012: Frank David Omary vs United Republic of Tanzania.
In the case of Mohamed Abubakari, the Pan African Lawyers Union (PALU) represented the Applicant on a pro bono basis under the African Court’s Legal Aid Scheme. The Applicant, a Tanzanian national, was convicted of armed robbery and sentenced to 30 years imprisonment.
The Applicant argued before the African Court that, taking into account the gravity of the offense he was charged with, by failing to provide him with legal assistance, the Respondent State had violated his right to a fair trial, as protected by Article 7 of the African Charter.
The Applicant therefore sought a Declaration from the African Court that the Respondent State violated his right to a fair trial and an Order for the Courts of the Respondent State to re-open his trial.
The Judgement will be delivered at the Seat of the African Court, located at TANAPA buildings, in Arusha, Tanzania. The Judgement will also be live-streamed via the link http://original.livestream.com/afchpr as well as our live tweets #PALUatCourt.
